So let's see. Interplay signs away their rights to the Fallout franchise, then tries to distribute their games ( under the franchise which Bethesda now owns ) on Steam, presumably without proper say-so from Bethesda, the current owner of said franchise.

Legality will be legality. When you sign something, you better fucking stick to it or else the same company that won't let people post game manuals online is gonna bite your arm off.

This kind of reminds me of that Activision/Double Fine situation where legality and who owned Brutal Legend created that big dispute. Though clearly, Bethesda is in the right here.

You can't opt to release a game(s) under a very specific contract that requires you to double check with the legal owners first. The same goes to a publisher that has no involvement in a game's development that tries to play "tap tap, savies" and cock blocks a game's release (ie. Activision in the case I mentioned before).

In all honesty though, when video game creators -- and I know it's a business first industry -- get into legal disputes over who owns what and who deserves money from product A from results B, it's hard to pin gaming as something to take seriously from a cultural standpoint, let alone a flamboyant one, when most games are treated as tools to create a kind of euphoria, through "being a standard" and a hallmark title, capable of generating money and a wealth of unneeded sequels. Believe me when I say that I don't want to be in a situation like that in the future with my own IP's, nor have to regulate the rights to a franchise that's in some way tangled up with another company. =P

I vote that we all buy this game. Although it is certainly different than our current FPS-based mindset. MMO + Fallout = Extra win.

So this keeps evolving.

Interplay is now counter-suing Bethesda.

Welcome to low-priority IP lawsuits. Where the pathetic sue the desperate over the mundane.

Makes me think of the time DCMH told us about his bank suing itself. =\
