Someone told me that if you get food to go, they don't tax you. It's a sit-down tax. So always ask for food to go in a fast food joint. However, in Cali we have a restaurant chain called In-n-Out Burger. Whenever you go through the drive through they ask you if you will be eating your food in the car - everyone does. They give you a bib and a box instead of a bag. However, according to my source, if you say yes to that question, even though you're taking it to go and not dining-in, they still charge you the dine-in tax. Does anyone know if this is true. I plan to fire off another of my famous letters if you can't come up with an answer and a source for the answer. Okay, go. You should be more like Cantrip. Twitchy: "I pulled a Cantrip . . ." " WDF?: "He keeps reaming me... night after night... I'm rather sore." GivePeaceAChance: "OMG MY NIPS ARE HARD" llenta: "cantrip, you fail!!!" Filliam H. Muffman: "i'm on top of dick"

Well its a "charge" some restuarants include. Not a government tax of any kind. Its usually a fee/charge they basically justify by saying that you are paying for the cleanup/maintainance of the eating area. If you take it to go...then you arent messing up thier dining area so they don't charge you.
As for in&out...I rarely went through the drive through....but it would be rediculous if they did charge you for eating in your car. Quote:

That is total BS. None of that crap here in TX. How much wood would a woodchuck chuck if a woodchuck could chuck wood?

They tax us here in maryland for both. An Eat-in tax or a Take Out tax. It's the same amount for either, but i think it's their word for sales tax. However, you can't put a tax on food, so i think it's just the state using words against us. Cantrip wrote:When I die, I want to be reincarnated as a woman's jogging bra.

You get taxed either way, because they've provided the service of preparing your food. You do not pay sales tax on groceries.
